EU Cosmetics Regulation (Regulation (EC) No. 1223/2009)
The regulation defines requirements for cosmetic products across Europe. I advise on:
- Differentiation between cosmetics vs. medicinal products vs. biocides
- Permitted and prohibited ingredients
- Preservative obligations and preservative limits
- UV filters and other legally restricted substances
Labeling and packaging
Cosmetic products must be correctly labeled. Requirements include:
- Mandatory information
- INCI nomenclature for ingredients
- Warnings and instructions for use
- Durability labeling
- Net quantity declaration
CPNP notification
Cosmetic products must be registered in the European CPNP (Cosmetic Products Notification Portal) database. I assist you with all legal issues relating to CPNP notification.
Ingredients and raw material compliance
Selecting safe and compliant raw materials is crucial. I assist with:
- Verification of ingredient permissibility
- Allergen labeling and risk warnings
- Raw material documentation and review
Competition law
I will of course also assist you if you have received a warning letter. If you have been warned by a competitor or by the Verband Sozialer Wettbewerb (VSW), the Wettbewerbszentrale, the Schutzverband gegen Unwesen in der Wirtschaft e.V. (Schutzverband), or another “warning association,” prompt legal assistance is urgently required. Together, we will develop a strategy to defend your rights.
Contract law
I assist you, for example, in drafting supplier and distribution agreements.
Have your cosmetic product legally reviewed by me before placing it on the market.
